1. Agreement

These Terms govern your use of gladtrucking.com, the Glad Transport Card customer portal and mobile app, our telephone and messaging communications, and the Glad Transport Card program (together, the “Services”), provided by Glad Transport LLC (“Glad Transport”, “we”, “us”). By using the Services or holding a Glad Transport Card you accept these Terms.

Card issuance, credit and settlement are additionally governed by the Cardholder Agreement you sign at application, and by our partners’ terms. Where the Cardholder Agreement conflicts with these Terms on a card matter, the Cardholder Agreement controls.

2. Who may use the Services

The Services are offered to businesses only. By using them you represent that:

  • you are at least 18 years old;
  • you are acting for a business engaged in commercial motor carriage, or for a business that services such carriers;
  • you are authorized to bind that business; and
  • the information you give us is true and you will keep it current.

We may verify your business against the FMCSA registry and other records, and we may decline or terminate service if we cannot confirm an active motor carrier operation.

3. What the Services are

Glad Transport Card provides a commercial fuel card usable at participating fuel networks, together with optional fleet services, IFTA filing support, EFS money codes, a web portal and a mobile app. Two card products exist: a prepaid card funded by you in advance, and a credit line settled on a billing cycle.

Discounts are variable and are not guaranteed. The discount available at any station moves with the market and with the location, and fuel network pricing models change. We do not promise a specific cents-per-gallon figure, we do not promise to beat another provider’s rate, and any figure discussed on a call or in marketing is an illustration, not a commitment. The only binding pricing is the pricing in your Cardholder Agreement and on your invoices.

Accepted networks change. The list of fuel networks and fleet service partners may change with notice. Coverage is not guaranteed at any particular station, and cards issued under different program accounts accept different networks.

4. Communications — calls, recording and AI agents

This section matters. Please read it.

4.1 Calls to you

We contact motor carriers by telephone at business numbers obtained from public carrier records and from licensed business data suppliers, and at numbers you give us. Our calls may be placed and conducted by an automated voice agent. The agent identifies the program at the start of the call, provides a callback path, and will confirm that it is an AI if you ask.

We call only between 9:00 a.m. and 8:00 p.m. in the recipient’s local time zone, and we cap the number of attempts per contact.

4.2 Recording

All calls with us are recorded and transcribed, inbound and outbound. Notice is given at the start of the call. In states requiring the consent of all parties, continuing the call after that notice constitutes your consent. If you do not consent to recording, say so and we will end the call or use another channel.

4.3 Stopping calls

You may stop our calls at any time, by any means, and we will honour it immediately and permanently. Saying “stop calling”, “remove me”, “take me off your list” or anything to that effect during a call is enough. You do not need to put it in writing. The number is suppressed during the call itself and our dialer will refuse it thereafter. See our Do Not Call and Consent Policy.

4.4 Text messages

By giving us a mobile number and agreeing at the point of collection, you consent to receive account, servicing and program text messages from Glad Transport Card. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Opt-out is immediate and permanent. Carriers are not liable for delayed or undelivered messages.

We do not share consent or opt-in data, or your mobile number, with third parties for their marketing.

4.5 Service communications

Even after you opt out of marketing, we may still contact you about an active account: transaction alerts, card status, invoices, funding and security notices. You can close your account if you no longer wish to receive these.

5. Applying, funding and paying

Application. For a prepaid card we collect name, email, telephone, address and a photograph of the driver’s licence. We never ask for a Social Security number, card number or bank credential verbally on a call — those are collected only through the secure application. If someone claiming to be from Glad Transport asks for them by telephone, hang up and call 888-485-0787.

Prepaid funding. You fund the card in advance. Minimum opening funding and minimum balance thresholds are set out in the Cardholder Agreement. A card whose balance falls below the stated threshold deactivates until it is funded.

Credit line. Credit is subject to underwriting by our verification team, which may include a credit report, insurance verification and identity verification. Approval, limits and card counts are determined by that team. Nothing said on a sales call approves credit or guarantees a limit.

Invoices and repayment. Credit-line accounts are invoiced on the cycle stated in the Cardholder Agreement and payment is due on the stated date. Fees, including service fees, shipping and processing fees, are set out in the fee schedule provided at application and may be updated with notice.

Late payment. We may suspend cards, decline authorizations, and pursue collection where an account is past due, as set out in the Cardholder Agreement.

6. Your responsibilities

You agree to:

  • keep card credentials, portal logins and driver assignments secure;
  • tell us promptly of a lost or stolen card, or suspected unauthorized use;
  • use the card only for legitimate business purchases of fuel and covered services;
  • keep your business, insurance and contact information current;
  • not resell, transfer or share your card or account access;
  • not use the Services to violate any law, including fuel tax, sanctions or anti-money-laundering law.

You are responsible for activity on your account, including activity by your drivers and staff.

7. Prohibited use

You may not: reverse engineer, scrape or overload our systems; attempt to gain unauthorized access; use the Services to defraud; misrepresent your business; attempt to obtain a card for a business you do not control; or use the Services in a manner that harms Glad Transport, our partners, or other customers.

8. Third-party services

Some features depend on third parties — fuel networks, EFS, Plaid, credit bureaus, repair and service partners. Their acts, pricing, availability and terms are their own. We are not responsible for a third party’s refusal to honour a card, a station’s pricing, or a shop’s workmanship, though we will help you resolve a dispute.

9. Intellectual property

The Services, the Glad Transport Card name and logo, the portal, the app and their content are ours or our licensors’. You receive a limited, revocable, non-transferable right to use them for your own business purposes while your account is in good standing. You may not use our marks without written permission.

10. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, particular savings, particular discount levels, or acceptance at any particular location.

11. Limitation of liability

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost fuel savings, or business interruption, even if advised of the possibility.

Our total aggregate liability arising out of or relating to the Services is limited to the greater of (a) the total fees you paid us in the twelve months before the event giving rise to the claim, or (b) one thousand United States dollars.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud.

12. Indemnity

You will indemnify and hold harmless Glad Transport, its affiliates, and its partners from claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Services, your violation of law, or activity on your account by your drivers or staff.

13. Suspension and termination

By you. You may close your account at any time by writing to support@gladtrucking.com. Amounts owed remain payable, and prepaid balances are returned in accordance with the Cardholder Agreement.

By us. We may suspend or terminate the Services, with notice where practicable and immediately where necessary, if you breach these Terms, if we cannot verify your business, if we suspect fraud or unauthorized use, if required by a partner or by law, or if your account is materially past due.

On termination, sections 5 (amounts owed), 9, 11, 12, 14 and 15 survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules.

Informal resolution first. Before starting a formal proceeding, the complaining party will send a written notice describing the dispute to the other and the parties will try in good faith to resolve it within 30 days.

Arbitration. If that fails, any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Columbus, Ohio. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual action in small claims court, and either party may seek injunctive relief in court to protect intellectual property or confidential information.

No class actions. Disputes will be brought only in an individual capacity and not as a plaintiff or class member in a class, collective or representative proceeding.

15. General

Entire agreement. These Terms, the Privacy Policy, the Do Not Call and Consent Policy, and the Cardholder Agreement are the whole agreement between us on their subject matter.

Changes. We may update these Terms. We will post the new version with a new effective date, and for material changes we will give notice by email or in the portal at least 14 days before they take effect. Continuing to use the Services after that means you accept the change.

Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.

Severability and waiver. If a provision is unenforceable, the rest stands. A failure to enforce a provision is not a waiver of it.

Force majeure. Neither party is liable for a failure caused by an event beyond its reasonable control, including carrier network outages, payment network failures, acts of government, or natural disaster.
